On 09.12.2020, Ms. Elsa Toska, judge at the Constitutional Court, attended the online regional conference on “Protection of property – ECtHR and national case-law in the Western Balkans”, which was organized by the Directorate General of Human Rights and Rule of Law of the Council of Europe. This activity was organized in the framework of the project ‘Supporting effective domestic remedies for implementation of ECtHR decisions’, horizontal facility for Western Balkans and Turkey’. The conference brought together judges from the courts of Montenegro, Bosnia and Hercegovina, Serbia and Kosovo, who exchanged their views and opinions on the similarities and differences between national systems with regard to property issues. There were also presented the ECtHR decisions in relation to the countries whose representatives attended the regional conference.
During her presentation, Ms. Toska introduced the case-law of the Constitutional Court of Albania on the property right and the impact of ECtHR decisions on the interpretation of constitutional standards of the property right.
